Samsung denied preliminary injunction against iPhone 4S in Italy

This is certainly not the kind of start for the new year, Samsung may have wanted for itself. Reportedly, the preliminary injunction it was seeking in Italy against the recently launched, iPhone 4S has met with failure, just close to a month after a similar request was rejected by a French court. Foss Patents confirms that Tribunale di Milano, the Milan-based Italian first-instance court for patent cases rejected Samsung's preliminary injunction request against Apple's iPhone 4S. Samsung's success in securing a preliminary injunction against Apple would have barred the sale of the latter's iPhone 4S in Italy.
Can sell in Italy
Reportedly, the court had conducted a hearing in this respect once before, too. But, the court stated that in order to come to a conclusion, it will need more than just one round of hearing. With the latest hearing having just concluded, it has come out clear that Judge Marina Tavassi of the Tribunale di Milano didn't seem too convinced with Samsung's claims, hence rejected it.
Stepping back a bit; it all began in October, last year, when Samsung had filed a lawsuit against Apple, accusing the Cupertino-based company's latest smartphone of violating two 3G WCDMA patents, which are in its possession. The post further points out to the fact that, "Samsung previously failed with a request for a preliminary injunction in the Netherlands. That one was brought before the French and Italian complaints over the iPhone 4S. Anyway, Samsung's requests for preliminary injunctions against Apple products have so far failed in all three European countries in which they were brought."
So, while the iPhone 4S continues to sell in Italy; one can be sure that Samsung won't be sulking for long. We await their next move.
