Apple may have exaggerated a bit in their case against Samsung

The ongoing battle between Apple and Samsung regarding the sales of the Samsung Galaxy Tab 10.1 continues. New evidence has emerged that the Cupertino-based company may have misled the court in Düsseldorf about the similarities between the Samsung Galaxy Tab 10.1 and the iPad 2, according to a report by Dutch publication, Webwereld.nl.

The court has ruled in favor of Apple and has banned Samsung from distributing their flagship tablet in Europe (except in the  Netherlands).  Apple seems to have won that round, however, in light of this new evidence, things may turn in favour of Samsung. According to the report, Apple, it would appear, seems to have knowingly or unknowingly misled the German court by claiming that the general impression of the two tablets is virtually identical. Apple apparently provided an image of the Samsung tablet which makes it look strikingly similar to the iPad 2. The report states that the image in Apple's lawsuit is reduced and the proportions are not correct. According to Samsung, their tablet measures at 256.7 x 175.3 millimeters, this represents an aspect ratio of 1.46. The alleged Tab in the summons has an aspect ratio of 1.36.

With this new evidence emerging, hopefully both Apple and Samsung will start to play fair in the tablet wars. After all, the consumer should be the winner. Stay tuned to see how this plays out for these two companies.
