Samsung fails to lift U.S sales ban on Galaxy Tab 10.1

According to the latest bit of information coming in pertaining to the Apple-Samsung lawsuit, Samsung has failed to get the U.S. sales ban effective on its Galaxy Tab 10.1 lifted, yet again, thereby bringing much disappointment to itself. According to reports, the U.S. Court of Appeals for the Federal Circuit refused to lift the existing preliminary injunction on Samsung's Galaxy Tab 10.1 in its latest ruling. As per Foss Patents, at the ruling, Samsung was denied two motions pertaining to the preliminary injunction on the sales of the Galaxy Tab 10.1 scored by Apple, sometime ago.  In its latest ruling, the court also denied Samsung's request to expedite its appeal on the matter.Expected very soon

Early this month, we had also reported about a U.S. appeals court lifting the ban on the sales of the Samsung's Galaxy Nexus smartphones, while staying the ban on the Galaxy Tab 10.1 tablet. The previous report further stated that the U.S. Court of Appeals for the Federal Circuit, in its brief order, denied Samsung Electronics' request to lift the ban prevailing on the U.S. sales of the Galaxy Tab 10.1. Reports quoted the court as saying, "Samsung's request for an immediate stay is denied."

 

Apple and Samsung patent feud continues to make headlines, despite being on for over a year.Those closely following the chronology of events pertaining to the Apple vs Samsung lawsuit would know that the one time friends have been at loggerheads, since a while now over a host of unresolved patents. Earlier reports revealed that the U.S. District Judge Lucy Koh in San Jose, California, rejected Apple's attempts to seek a ban on some Samsung smartphones and the Galaxy 10.1 tablet. Later, the judge was asked by the appeals court to "reconsider Apple's request regarding the tablet". When Apple sought for a ban again, the judge denied it on procedural grounds stating that the appeals court " must formally cede jurisdiction back to her before she could consider it". And it is only once this happens, that Apple will be able to file for a ban request with the U.S court. 

 

Sometime ago, according to reports the CEOs of Apple Inc. and Samsung Electronics had met over two days in San Francisco, in what essentially was a court-directed mediation, seeking to end the longstanding lawsuit, which saw the one time friends turn foes. However, the talks that lasted 2 days - nine and seven hours respectively, failed to elicit any decision. Both Apple and Samsung, as per a series of earlier reports, have locked horns over a host of patents, which each claim has been infringed by the other. At this juncture, a successful outcome of the court-directed mediation talks would have been crucial to the future of both companies. Over the course of the months, the battle between the two technology giants has intensified, with both the companies leaving no stone unturned in ensuring that their products reign supreme in the market.
