Apple Sued by iCloud Communications

In the latest trademark dispute against Apple, iCloud Communications is suing Apple over the name of the Cupertino-based company’s newest cloud based service. iCloud communications is an Arizona based VoIP equipment, service provider and cloud computing company that has been offering services, since 2005.

iCloud Communications sues Apple

According to a report, iCloud Communications have filed a lawsuit against Apple which states the goods and services with which Apple intends to use the “iCloud” mark are identical to, or closely related to the goods and services that have been offered by iCloud Communications under the iCloud Marks since its formation in 2005.  However, due to the worldwide media coverage given to and generated by Apple’s announcement of its “iCloud” services and the ensuing saturation advertising campaign pursued by Apple, the media and the general public have quickly come to associate the mark “iCloud” with Apple, rather than iCloud Communications.

The report goes on to say that the lawsuit also alleges that Apple have had a long and well known history of knowingly and wilfully treading on the trademark rights of others. The complaint calls for Apple to produce all profits, gains and advantages and also all monetary damages sustained. Further to this, they want Apple to deliver for destruction all labels, signs, prints, insignia, letterhead, brochures, business cards, invoices and any other written or recorded material or advertisements.

Apple filed the iCloud trademark in Jamaica last December and last week in Europe and the U.S.
