| A case filed against Google by Kinderstart has been dismissed. The case had involved Kinderstart's fall in the Google search index which had lead to loss of revenue from both search hits and Google's own Adsense programme. The lawsuit had claimed that by lowering KinderStart's site in its PageRank system, Google had engaged in "pervasive monopolistic practices" that led to the denial of free speech rights, prevention and destruction of competition, and predatory pricing, among a total of nine counts. U.S. District Judge Jeremy Fogel for the Northern District in San Jose dismissed all nine claims, saying that KinderStart's claims were insufficient or failed to allege facts or conduct to support the claims. The judge however specifically dismissed some of the claims against Google "with leave to amend," noting in his dismissal meaning that KinderStart can modify and refile the complaint. |
